website constitutes your agreement to the following terms and conditions. If

| Chocolate Products Return Policy: |

Chocolate products may not be returned
without prior approval from TCS. In order for any chocolate product to be
returned it must be in the original unopened package. Any return must be marked
with the return authorization number issued by TCS. You must notify TCS of your
desire to return any chocolate product within 10 days from the date received (as
reported by the shipping service). Returned items must be shipped to TCS as
directed both prepaid and insured against damage. You will be credited at
invoice price less outgoing shipping fees and a 25% restocking charge.

| The shipping company is responsible for your
order after it has left TCS. Please thoroughly inspect the package(s)
immediately upon receipt; if damage is found or suspected, note condition of
both the merchandise and packing material and notify the shipping company. Save
all materials for inspection for the shipping company. |

Chocolate Fountain Return Policy:
|

Chocolate fountains may not be returned

| Chocolate fountain warrantee: |
| Our fountains have a limited
lifetime warranty. Please contact TCS immediately if your fountain
fails to operate properly because of a factory defect. All defective parts
will be replaced FOB within two years at no cost Bearings, gaskets,
heater, motor and electronics will be repaired after 2 years FOB for a fee
of $75 for labor plus handling and shipping charges. Timeliness of repair
and replacement are subject to parts availability. Call for return

| Delivery Confirmation:
|
| TCS will deem your order delivered if the
shipping company records show the package was delivered to the address you
provided. |
| Refused Shipments or Failure of Delivery: |
| Any shipment that is returned to TCS by
shipping carriers due to: refusal of delivery; incorrect address supplied by
customer; undeliverable address or delivery failure due to lack of availability
on recipient's part will not be automatically refunded. Refunds that are
requested and that have been approved by TCS will automatically incur a 25%
restocking fee If the customer wishes for the order to be re-shipped, a
shipping charge will be billed equal to the actual shipping charge. |

Shipping Carrier and Packaging:

| TCS reserves the right to change shipping
method as long as there is reasonable expectation that the products ordered will
be received by the customer on or before the time the original carrier can
deliver the package. TSC may split packaging of products into multiple boxes as
required. |
| Sales Receipt Confirmation: |
| The receipt generated by TCS website
represents a confirmation of sales information. TCS reserves the right to
review the information and validate quantity and pricing information. If a
discrepancy occurs TCS will notify you by e-mail and TCS may cancel the order at
its sole discretion. You will also have the right to cancel the order within 24
hours after notification of any change in quantity or pricing for your order. |
| Limitation of Liability: |
| TCS shall not be liable for any direct or
indirect damages arising out of or in connection with the use of or inability of
its website. This limitation of liability applies to all losses and damages of
any kind (whether incidental, consequential, general, special, exemplary or
otherwise including, without limitation, the loss of profit, income or data). |

the content within the website, or with these terms and conditions, your sole
and exclusive remedy is the right to discontinue use of this website. By your

transaction between TCS and you shall be paid by you in addition to the prices
quoted or invoiced. In the event TCS is required to pay any such tax, fee or
charge, you agree to reimburse TCS. If you are exempt from any taxes that might
be applicable you shall provide TCS at the time the order is an exemption
certificate or other document acceptable to the authority imposing the tax, fee
or charge. If you are reselling the product purchased on this website in whole
or as part of product or services you provide you must include your federal
identification number with your order.
